Deputy Ombudsman acquitted of criminal charges

Deputy Ombudsman, Maualaivao Pepe Seiuli was acquitted of the criminal charges against him in the District Court last week. 

This follows a hearing held before Faamasino Fesoasoani Masinalupe Tusipa Masinalupe, where nine witnesses were called on the prosecution side. 

On Friday, two charges of insulting words and one count of threatening words were dismissed against the Deputy Ombudsman. 

This was confirmed by his lawyer, Alex Su’a in response to questions from Radio Polynesia. 

Last year Maualaivao was charged in line with a complaint filed by former Member of Parliament, Maualaivao Pat Ah Him two years ago over heated discussions during a Village Council meeting pertaining to candidates to contest during the general election last year. 

Faamasino Fesoasoani Masinalupe in delivering the decision says the prosecution failed to prove there was no reasonable doubt with the case. 

Samoa Global News reported the Court found that prosecution witnesses agreed it was a usual practice for matai to lift their voices and speak frankly toward each other during Village Council deliberations. 

The words were spoken directly and although with a strong tone, there was no altercation or fight between matai during the Village Council meetings in question.

It was also confirmed in the court that there is a separate case against the Deputy Ombudsman scheduled in September also relating to deliberations over a Village Council Meeting.
