Regulator warns to take “legal action” against Bluewave to submit financial statements

The Office of the Regulator has issued an order against BlueWave Wireless (formerly known as NetVo Samoa) Telecommunication Company to submit audited financial statements no later than 22 June 2022.

The order signed by the Regulator, Lematua Gisa Fuatai-Purcell is dated 16 June 2022 and was obtained by Radio Polynesia.

The order says that subsequent to several requests by the Office of the Regulator and the “unresponsiveness of Bluewave” to the requests to submit audited financial statements required for the calculation of Bluewaves annual license fees as per the prerequisite of the relevant law and Bluewave’s license, the Regulator has seen it fit to issue such an order.

The Regulator cited section 77 of the Telecommunications Act 2005. Furthermore, the financial statements are for the period of 1 July 2020 to 30 June 2021 for the purpose of calculating Bluewave’s license fees no later than 22 June 2022.

The Regulator warned that failure to respond or to comply with the Order will result in the Office of the Regulator taking appropriate legal action for non-compliance.
